Under Fed.R.Civ.P. 45, which covers subpoenas, there is no requirement that leave be sought prior to issuance. The defendants motion cites no case law in support of their request, and none in support of their contention that there is no basis for [their] intended subpoena to be quashed or modified or that the plaintiff does not have standing to object. See United States v. Cisneros, 846 F.3d 972, 978 (7th Cir. 2017)(We have repeatedly and consistently held that perfunctory and undeveloped arguments, and arguments that are unsupported by pertinent authority, are waived. (quotations omitted)). The motion also does not describe the target of the subpoena accurately. The motion claims it seeks documents from a bank account opened in defendants name [Dkt. #64, 2], but it also clearly seeks records from an individual account identified by social security number. [Dkt. #64-1]. The motion [Dkt. #64] is denied. That does not mean that defendants are precluded from issuing their subpoena; as already indicated, prior leave is not necessary. Of course, as the defendants seem to fear, if a motion to quash is filed, and it turns out to be well-taken, the defendants could be liable for attorneys fees and expenses if they force a prevailing objecting party to incur. Fed.R.Civ.P. 45(d)(1); Elliot v. Mission Tr. Servs., LLC, No. 14 C 9625, 2015 WL 1567901, at *6 (N.D. Ill. Apr. 7, 2015). But none of this is certain and more importantly, none of this has occurred, and a federal court cannot issue an advisory opinion. Consequently, we must wait for there to be a case or controversy on this particular issue. the mere fact that a case is pending does not give a court authority to issue within the context of that case any orders it pleases.
