Filing 327 MEMORANDUM OPINION AND ORDER signed by the Honorable Matthew F. Kennelly on 4/12/2024: For the reasons stated in the accompanying Memorandum Opinion and Order, the Court grants the City's motion for summary judgment [dkt. no. 291] on the plaint iffs' claims of discrimination involving denial of promotion, overtime pay, shift assignment, and acting up; Anderson's discriminatory discipline claims; and Edmond and Smith's hostile work environment claims. The Court denies the City 's motion for summary judgment on Ealy, Cooper, and Glenn's discriminatory discipline claims and the remaining plaintiffs' hostile work environment claims. Those claims will proceed to trial. Counsel are directed to promptly confer r egarding the anticipated witnesses and anticipated length of trial given the dismissal of a number of claims, and they are to file a joint status report in this regard by no later than April 19, 2024. The Court notes that it likely will be moving the start date for the trial to Wednesday, June 5, 2024. The alternative claim pleaded in Count V against the individual defendants in their individual capacities is dismissed in part.
