MEMORANDUM Opinion and Order signed by the Honorable Edmond E. Chang on 9/3/2018: For the reasons stated in the Opinion, Defendant Schwartz's motion 36 to dismiss is denied for now, and Defendant Spitz's motion 31 to dismiss is granted as to the ERISA claims. The state law claims against Spitz are stayed for now. Discovery shall commence on Defendant Schwartz's statute of limitations defense. The parties shall make Rule 26(a)(1) disclosures on the issue, and the defense may i ssue an interrogatory request asking for the Plaintiffs for the specific legal and factual bases of the defense (at the same time, the Plaintiffs may initiate discovery on the defense too). The case management plan will be discussed at the next status hearing. To give the parties a chance to review this Opinion and consider next steps, the status hearing of 09/05/2018 is reset to 09/20/2018 at 10:30 a.m. Emailed notice(Chang, Edmond)
