February 27, 2020	Filing 84 MEMORANDUM Opinion and Order. Plaintiff Colbert forfeited his retaliation claim against Defendant IDOT and all claims against McKay as a Defendant. Defendants' motion for summary judgment 51 is granted as to these claims (Counts IIIV). But P laintiff has raised a genuine issue of material fact regarding whether he is similarly situated to white IDOT employees who were treated more favorably than him, and whether IDOT's explanation for his discharge was pretextual. Accordingly, Defe ndant IDOT's motion for summary judgment on Count I (Title VII race discrimination) 51 is denied. The parties are encouraged to discuss a settlement.
