MEMORANDUM Opinion and Order signed by the Honorable Virginia M. Kendall on 8/15/2018. The Court grants in part and denies in part Defendants' Motion to Dismiss 31 . Count III is dismissed without prejudice. Plaintiff shall have one last oppor tunity to amend Complaint to the extent she can do so. Second Amended Complaint shall be filed on or before 9/5/2018. The case will proceed to discovery on Wicik's remaining claims as they relate to those claims included in her December 2, 2016 Charge of Discrimination. Wicik's ADA Discrimination (Count I) and Title VII Retaliation (Count III) claims ar e dismissed in total. her FMLA claim (Count II) is dismissed only to the extent it is brought against Defendant Harper; it remains pending against Defendant CCHHS and will proceed to Discovery. Wicik is given until April 13, 2018 to file an amend ed complaint consistent with this opinion to the extent that she can do so.
