Plaintiff's motion to compel is granted. #27 While it is true that the language of paragraph B.3 of the MID standing order could plausibly be construed as requiring simply the listing of relevant non-ESI documents, the intent of the order is to allow for early disclosure of relevant documents to allow for expediting litigation and avoiding unnecessary expense relating to discovery motion practice. The correct interpretation of the paragraph is that a party may either produce documents or make them available for inspection, but not withhold them entirely. Merely listing them in lieu of production or inspection does nothing to inform the other side of their actual contents. If a party chooses to list them, it then has to either produce them or make them available for inspection upon request. This is also consistent with the spirit of paragraph B.7 of the MID standing order. Plaintiffs motion to compel is granted.
