ORDER : For the reasons stated below, the court allows plaintiff's amended complaint 20 filed pursuant to Fed. R. Civ. P. 15(a)(1)(B) and naming Murphy as a defendant to stand. Because this amendment destroys subject matter jurisdiction, pla intiff's motion 17 to remand is granted.
