Filing 162 OPINION and ORDER: In this insurance coverage dispute over fire damage at a vacant hospital building, Berkshire Hathaway Homestate Insurance Company and Chicago Metropolitan Hospital, LLC have filed cross-motions for summary judgment. For the reason s explained herein, Chicago Metropolitan's motion (dkt. 129 ) is denied. Berkshire's motion (dkt. 123 ) is granted as to Chicago Metropolitan's counterclaim under Section 155 of the Illinois Insurance Code (Count III of the second am ended counterclaim) and denied in all other respects. Berkshire's motion against Robert D. and Kathleen C. Dieleman (dkt. 126 ) is denied. The matter is set for status on February 23, 2021 at 11:00 a.m. The parties should be prepared to discuss whether this matter can be settled without further litigation. Throughout the telephonic hearing, each speaker will be expected to identify themselves for the record before speaking. Please note that the conference call-in will be used by all cas es that are on the court's calendar for the said date, therefore counsel must be in a quiet area while on the line and must have the telephone muted until your case is called.
