Filing 140 MINUTE entry before the Honorable Matthew F. Kennelly: This case involves a claim to vacate a labor arbitration award. Plaintiff, via recruited counsel, has subpoenaed from the arbitrator an audio recording that the arbitrator made of the hearing. The arbitrator has moved to quash, citing "arbitral immunity" and privilege. These contentions are baseless. First, immunity does not come into play here, because plaintiff is not asserting any legal claims against the arbitrator; rather she is just seeking the arbitrator's recording of the hearing. Second, the claim of (apparently) work product privilege is specious. Though the arbitrator may have used the recording to form mental impressions, the recording itself is simply a verbatim record of the proceedings before her; it does not include any mental impressions at all. Finally, the arbitrator argues that enforcing the subpoena will undermine the process of alternative dispute resolution. That is, frankly, absurd. Again, we are talking about a verbatim record of the proceedings here, not (as the arbitrator suggests in her motion) her private notes or anything implicating her mental impressions. The arbitrator, via counsel, is directed to immediately provide the recording to the parties for copying, and after copying the parties are to return it to the arbitrator via counsel.
