MEMORANDUM Opinion and Order signed by the Honorable Edmond E. Chang on 3/31/2020: For the reasons stated in the Opinion, the defense's motion 45 to dismiss is granted in part and denied in part. The only surviving claims are against Metra, an d they are (1) intentional discrimination on the basis of disability (diabetes); and (2) retaliation (based on the 2016 disqualification) for engaging in protected activity (complaining about race, age, sex, and disability discrimination). In additio n, Haymon may reallege any other disability discrimination claim she might have in a second amended complaint by 04/29/2020. Otherwise, the discrimination claims on the basis of her religion, age, sex, and race are dismissed in their entirety, and wi th prejudice; all of the claims are dismissed against the individual Defendants with prejudice; and the retaliation claim is dismissed with prejudice (except as to the 2016 disqualification). On the surviving claims, the parties shall make Mandatory Initial Disclosures by 04/28/2020. See R. 8 and the Court's website for information about the disclosures. Using the attached template, the parties shall file a joint status report by 05/20/2020. The status hearing of 04/07/2020 is reset for 05/ 27/2020 at 9:30 a.m. For any hearing not involving a witness under oath, any party or lawyer wishing to appear by phone rather than in person may email a request with a direct-dial phone number to Judge Chang's courtroom deputy, Michael_Wing@ilnd.uscourts.gov, before 1:00 p.m. on the business day prior to the hearing date.
