October 24, 2018 Filing 28 MINUTE entry before the Honorable Rebecca R. Pallmeyer: Ruling held on 10/24/2018. Defendant's motion to dismiss Plaintiff's amended complaint #19 is granted. Plaintiff's original complaint makes no mention of the presence of Superintendent Eddie Johnson, but in an affidavit submitted in response to Mr. Johnson's motion to dismiss, Plaintiff asserts that Mr. Johnson was indeed among the many officers involved in the alleged violation of his rights. The court notes, however, Defendants' observation that the complaint in this case, filed more than two years after the incident giving rise to the litigation, appears to be time-barred. See Wallace v. Kato, 549 U.S. 384, 387 (2007). The case is dismissed without prejudice. Mr. Cowart-El has leave to seek reinstatement within thirty (30) days, but only if he can state a timely claim. Civil case terminated. Mailed notice. (etv, )
