The court notes, however, Defendants' observation that the complaint in this case, filed more than two years after the incident giving rise to the litigation, appears to be time-barred. See Wallace v. Kato, 549 U.S. 384, 387 (2007). The case is dismissed without prejudice. Mr. Cowart-El has leave to seek reinstatement within thirty (30) days, but only if he can state a timely claim.
