The Court denies the motion #94 ; the second amended complaint, like its predecessor, sufficiently alleges each of the defendants' personal involvement in the claimed constitutional violation(s). The Court also disagrees with the contention in the motion that it previously approved only official capacity claims against the defendants. The Court's order reviewing the original complaint, in which plaintiff, then pro se, named as defendants Sheriff Dart and two then-unnamed defendants, a sanitation supervisor and the Division 11 superintendent, is relatively clear in assessing the sufficiency of allegations of these individuals' personal involvement in the claimed violation(s). The same is true of the order reviewing the first amended complaint. Though the Court expressly approved official-capacity claims against five defendants, it also noted that plaintiff appeared to be asserting individual-capacity claims against them, and the Court did not dismiss those claims and thus implicitly allowed them to proceed--which the Court now confirms was its intention at the time. (The Court notes in this regard that if it had been approving only official-capacity claims, there would have been no need for five named defendants, as an official-capacity claim against a named official amounts to a claim against the entity employing that official, which here likely was the same entity for each of the five.) For these reasons, the Court denies the motion to dismiss #94 . (mk)
