April 10, 2018 Opinion or Order Filing 14 ORDER: Plaintiff Samuel moves to consolidate these cases and to appoint his counsel as interim class representative. Plaintiffs Quint, Musso, Eric J. Levy, Living Trust UA Dated 1/21/10 ("Levy"), and Barry do not oppose consolidation, but wish to have their counsel considered for a leadership role. All of these actions, as well as two actions pending in the Northern District of Illinois, are currently being reviewed by the Judicial Panel on Multidistrict Litigation ("JPML") to determine whether they should be centralized in one location. See In Re: Chicago Board Options Exchange Volatility Index Manipulation Antitrust Litigation, MDL No. 2842. The motion before the JMPL will be fully briefed on April 16, 2018. Interested party Atlantic Trading, USA, LLC ("Atlantic Trading") opposes the motion before this Court for consolidation and appointment of interim class counsel and requests that the Court postpone any resolution of these issues until after the JPML has ruled. In light of the significant effect of the JPML's decision on any case management, the Court will defer any decision on consolidation and the appointment of interim lead counsel. The parties are ORDERED to file a letter with the Court within one week of the JPML's decision and recommend an appropriate course of action.
