Defendants' Motion to Strike Farmilant's Declaration and Report 155 is denied without prejudice, but Plaintiff is estopped to rely upon Dr. Farmilant's Declaration or Report in opposing Defendants' motion for summary judgment for the reasons set forth in the Court's Memorandum Opinion and Order of even date. MEMORANDUM Opinion and Order: For all the reasons discussed in the Court's Memorandum Opinion and Order, Defendants' Motion to Dismiss is granted in part and denied in part. Defendants' Motion is denied as to Counts I and III, excep t that Ross's request that he be allowed to voluntarily dismiss the claims in Count I and III against Chief Hyland is granted.
