Filing 6 MINUTE entry before the Honorable Gary Feinerman:The 7/24/2018 order #3 denied Plaintiff's in forma pauperis application because he has "struck out" under 28 U.S.C. 1915(g), gave Plaintiff until 8/21/2018 both to pay the $400 filing fee #3 and to show good cause in writing why this case should not be dismissed with prejudice for his failure to fully disclose his litigation history, and warned that failure to comply would result in dismissal. Plaintiff has not paid the filing fee; instead, he submitted an uncertified in forma pauperis application #5 , along with a letter #4 explaining that he "misinterpret[ed]" the language of the form complaint requiring him to disclose his litigation history and "contest[ing]" the dismissal of prior actions for failure to state a claim. Plaintiff may not contest the dismissal of prior lawsuits here, and his explanation for not disclosing his prior litigation is unconvincing given the unambiguous language of the form complaint. Accordingly, this case is dismissed with prejudice for Plaintiff's failure to pay the filing fee and also for his failure to fully disclose his litigation history in his complaint. Application for leave to proceed in forma pauperis #5 is denied. Status hearing set for 9/5/2018 #3 is stricken. Enter judgment order. Civil case closed.Mailed notice. (jlj, ) |
