| Filing 13 MINUTE entry before the Honorable Thomas M. Durkin:The Court dismissed Plaintiff's pro se complaint without prejudice for lack of jurisdiction, because Plaintiff's claims must be raised in a state court appeal of the underlying state court decision. In the alternative, the Court held that Plaintiff's allegations against the defendant state court judge concern actions taken in the judge's judicial capacity, for which the judge is immune from suit. Plaintiff has filed a motion to reconsider arguing that "judicial immunity is lost when a [j]udge lacks jurisdiction," R. 11 at 2, and that judges "cannot invoke judicial immunity for acts that violate [a] litigant's civil rights," id. at 5. Plaintiff does not contest the Court's holding that the Court lacks jurisdiction over Plaintiff's claims. Therefore, the motion to reconsider #11 is denied without appearance.
