***Civil Case Terminated. (rao, ) |
Filing 6 ORDER: Plaintiff's application for leave to proceed in forma pauperis #3 is granted. The Court orders the trust fund officer at Plaintiff's place of incarceration to deduct $20.82 from Plaintiffs account for payment to the Clerk of Court as an initial partial payment of the filing fee and to continue making monthly deductions in accordance with this order. The Court directs the Clerk of Court to send a copy of this order to the trust fund officer at the Sheridan Correctional Center. Summonses will not issue at this time as the Court dismisses Plaintiff's complaint #1 without prejudice. Plaintiff is granted until October 24, 2018, to submit (1) an amended complaint (if he can do so consistent with Federal Rule of Civil Procedure 11) and (2) a completed USM-285 service form for each Defendant named in the amended complaint. If Plaintiff fails to comply with the foregoing instructions, the Court will dismiss this case as set forth below. Plaintiff should consider whether, before initiating this lawsuit, he completed the administrative review process (i.e., fully exhausted all available administrative remedies, including appealing denied grievances). If Plaintiff did not fully exhaust his remedies prior to filing this lawsuit, he may (instead of the items set forth above) submit a notice of voluntary dismissal for dismissal of this case without prejudice to Plaintiff initiating a new lawsuit when he has exhausted those remedies. The Clerk is directed to send Plaintiff an amended civil rights complaint form, a blank USM-285 service form and instructions, and a copy of this order. Plaintiffs motion for attorney representation #4 is denied without prejudice to later renewal. Signed by the Honorable Ruben Castillo on 9/5/2018. Mailed notice(gcy, ) |
