Filing 6 MINUTE entry before the Honorable Manish S. Shah: By order dated August 17, 2018, the Court denied Plaintiff's application for leave to proceed in forma pauperis without prejudice and ordered Plaintiff to either submit a properly completed application, including supporting documents, or pay the Court's $400.00 filing fee. In addition, Plaintiff was required to submit an amended complaint. At that time, the Court warned Plaintiff that failure to comply by September 17, 2018, would result in summary dismissal of this case. Plaintiff has neither submitted a renewed application for leave to proceed in forma pauperis nor paid the Court's filing fee. Plaintiff did not submit an amended complaint to date. Accordingly, this case is dismissed without prejudice for Plaintiff's failure to comply with the Court's order. The Court directs the Clerk of Court to terminate all pending motions as moot. Terminate civil case. Notices mailed. (psm, ) |

If Plaintiff wishes to pursue this litigation, by September 17, 2018, he must: (1) pay the full statutory filing fee of $400 or submit a renewed application for leave to proceed in forma pauperis using the Court's form and (2) submit an amended complaintcomplying with the instructions contained in this order. If Plaintiff fails to comply with this order, the Court will summarily dismiss this case. The Clerk is directed to send Plaintiff an application for leave to proceed in forma pauperis, an amended civil rights complaint form with instructions, a blank USM-285 service form, and a copy of this order.
