Parties appeared telephonically. Oral argument heard. For the reasons stated on the record, over defendant City of Joliet's objection, defendant's motion to strike plaintiff's request to admit facts #208 is denied. The Court finds that the plaintiff's five requests to admit facts are limited to the discrete area of the Regional Computer Forensic Laboratory ("RCFL"). The Court has expressly permitted discovery as it related to the RCFL pursuant to the order in Dkt. #196 . The Court finds that discovery relating to the discrete area of RCFL is foundational and not burdensome for the Defendant City of Joliet to answer and would not prejudice the Defendant City of Joliet. Therefore, the Defendant City of Joliet's objections as to timeliness for all five requests are denied and answers to the plaintiff's requests are required. After reviewing the parties' joint status report, the Court directs the parties to file an additional status report by 8/25/21 that addresses the following issues: 1) Status of responses to supplemental written discovery issued by plaintiff (see p. 2 of status report); 2) A statement by defense counsel as to the scope of work already done or requested to be completed by the City of Joliet and the individual defendants (hereinafter "defendants") by the Regional Computer Forensics Laboratory (":RCFL"). Specifically, the Court is interested in understanding whether the defendants submitted digital devices (including but not limited to cell phones, computers, and other electronic devices) for examination "in reaction to Plaintiff's complaint" (as suggested at page 3 of the status report), as opposed to work completed by the RCFL in connection with the original criminal investigation referenced in plaintiff's complaint. To the extent digital devices were submitted PRIOR to plaintiff's lawsuit and in connection with the underlying criminal investigation, the Court has no concerns. However, to the extent digital devices were submitted after plaintiff's civil lawsuit was filed, the Court will want further documentation as to why such a request was proper, as the RCFL's work is limited solely to criminal investigation. Specifically, if the defendants intend on relying on the work of the RCFL for discovery purposes in this civil matter, the Court directs defendants to provide an affidavit from an appropriate manager at the RCFL documenting that the manager understands the work requested is for a civil matter, such a request will be fulfilled by the Chicago RCFL, and when she anticipates the work being completed. If, as the Court suspects, the RCFL management is not aware that this request is requested to support the defense of a civil matter, and the RCFL will not be able to complete the work because it is not related to a criminal investigation, the Court directs defendants to submit the name of an alternative vendor that it intends on using to accomplish any forensic examination that it believes is necessary to defendant this matter. The Court will address any necessary changes in discovery scheduling as appropriate, but warns defendants that any selected vendor must be able to promptly address the discovery needs of the case. 3) Status of supplemental written discovery issued by defendants to the plaintiff, and whether motion practice is necessary to address defendants' concerns as to plaintiff's responses, or whether the issues have been resolved by the parties (see generally, p. 4 of the status report). MINUTE entry before the Honorable M. David Weisman: The Court has reviewed the emergency motion filed in this matter, generally related to the scheduling of depositions. (Dkt. #134 .) Undoubtedly, plaintiff's counsel has "another side to the story." The Court considers the practice of law a profession, guided fundamentally by the principles of respect and professionalism towards others, including opposing counsel. The current state of affairs falls far short of the professionalism this Court expects from attorneys appearing before it. Without prejudice to either side, the Court would like to move beyond this situation without hearing arguments from counsel that would ultimately reflect poorly on each of us and the profession. Therefore, the Court grants in part the motion #134 as follows: (1) by COB on 4/9/21, counsel shall submit a joint status report reflecting an agreed deposition schedule for each of the currently noticed depositions; (2) the scheduling of depositions will not be contingent upon plaintiff's deposition proceeding first. There is no rule or caselaw that requires plaintiff's deposition to be the first deposition conducted in the discovery sequence; and (3) any subpoena or notice of deposition that has been served, issued, or otherwise presented shall be quashed or modified to the extent that the date and time of said subpoena does not match with the agreed deposition schedule (as described above). At this time, the Court is not inclined to award costs or other sanctions related to this motion, and does not anticipate similar problems in the future. That said, if the parties are unable to agree on a deposition schedule, the Court will reconsider the appropriateness of other relief as a means of encouraging counsel to abide by their professional obligations to each other, and the Court. As discussed, the Court has concerns that the Younger abstention applies here. In Younger v. Harris, 401 U.S. 37, the court held that "federal courts must abstain from taking jurisdiction over federal constitutional claims that may interfere with ongoing state proceedings." Gakuba v. O'Brien, 711 F.3d 751, 753 (7th Cir. 2013) (citing SKS & Assocs., Inc. v. Dart, 619 F.3d 674, 677 (7th Cir. 2010)). Because some of the issues raised in this case may also be litigated in the criminal case against Plaintiff (should a criminal case be initiated against Plaintiff), a stay is warranted at this time.
