Guzman: This is an action filed by E*TRADE Financial Corporation seeking injunctive relief pending arbitration before the Financial Industry Regulatory Authority ("FINRA") as well as expedited discovery. The Court granted E*TRADE's motion for a temporary restraining order and denied E*TRADE's motion for expedited discovery and to set a preliminary-injunction hearing. The temporary restraining order has expired (E*TRADE did not seek its extension). On September 25, 2018, the Court entered an order stating that, due to the FINRA arbitration, it appears that nothing remains for this Court to adjudicate. The Court allowed the parties to file a statement by October 2, 2018 in the event they believed differently, and stated that otherwise, the Court would dismiss this action for lack of any remaining controversy. Neither plaintiff nor defendant filed anything in response to the Court's order. The Court finds that it lacks subject-matter jurisdiction over this case because there is no remaining controversy.
