Filing 13 ORDER ; The Court has reviewed Plaintiffs letter #7 , which he submitted in response to the rule to show cause #5 based on misrepresentations in his application for leave to proceed in forma paupers. The rule to show case #5 is discharged. Plaintiffs application for leave to proceed in forma pauperis #12 is granted. The Court orders the trust fund officer at Plaintiffs place of incarceration to deduct $30.16 from Plaintiffs account for payment to the Clerk of Court as an initial partial payment of the filing fee and to continue making monthly deductions in accordance with this order. The Court directs the Clerk of Court to send a copy of this order to the trust fund officer of the facility having custody of Plaintiff. The trust fund officer is directed to collect the filing fee in this matter and Plaintiffs five other concurrently filed cases as addressed below. Summonses, however, shall not issue. Plaintiffs complaint #1 is dismissed without prejudice for failure to state a claim. If Plaintiff wants to proceed with this lawsuit, he must submit an amended complaint that states a federal claim against proper defendants. Failure to submit an amended complaint by November 30, 2018, will result in dismissal of this lawsuit for failure to state a claim. Plaintiff also must promptly submit a change-of-address notification if he is transferred to another facility or released. If Plaintiff fails to keep the Court informed of his address, this action will be subject to dismissal for failure to comply with a Court order and for failure to prosecute. Plaintiffs motion for attorney representation #4 , which does not reflect what efforts he made to obtain counsel on his own, is denied without prejudice to renewal should this case be allowed to proceed. The Clerk of Court is directed to send Plaintiff an amended complaint form, a blank USM-285 form, and instructions along with a copy of this order. Plaintiffs duplicative applications to proceed in forma pauperis #6 #8 #11 are stricken, and the Clerk is directed to terminate them as pending motions. Signed by the Honorable Virginia M.
