For the reasons stated in the Order, on screening review, Plaintiff's amended complaint #33 states a claim against three of the Doe Defendants, namely, John Doe Intake Doctor, Jane Doe Division 6 Nurse, and John Doe Division 6 Doctor. And the Cook County Sheriff's Office remains in the case to identify those Doe Defendants. The Court has reviewed Plaintiffs "affidavit" #10 , which he submitted in response to the rule to show cause #7 based on misrepresentations in his original application to proceed in forma pauperis. The rule to show cause #7 is discharged. Plaintiff has represented that he misunderstood the questions on the application and received inaccurate advice from other inmates. Although all deposits to an inmates trust fund account are "income" for purposes of calculating monthly installment payments under the Prison Litigation Reform Act, see Lucien v. DeTella, 141 F.3d 773 (7th Cir. 1998), the Court will accept Plaintiff's assertion that he did not act in bad faith. But Plaintiff's amended application to proceed in forma pauperis #9 is denied, for lack of indigency, as explained in the Order. Plaintiff is directed to pay the full statutory filing fee of $400.00. Plaintiff may pay by check or money order made payable to Clerk, United States District Court. Failure to pay the $400 filing fee by 04/26/2019, will result in dismissal without prejudice for failure to pay the filing fee. The Clerk is directed to send Plaintiff a copy of this order. To track the case only (no appearance is required), the status hearing of 04/19/2019, is reset to 05/0/2019 at 8:30 a.m. Also, at this early stage in the case, Plaintiff's motion #4 for attorney representation is denied.
