Filing 18 MINUTE entry before the Honorable Edmond E. Chang: Motion hearing held on Plaintiff's motion for remand #15 . As discussed during the hearing, Plaintiff and the defense agree that the federal Constitutional claims are not yet ripe. Accordingly, the Court dismisses the federal Constitutional claims, but without prejudice, for lack of subject matter jurisdiction. Both sides also agree: (1) no claim preclusion will arise out of the dismissal; and (2) if the claims ripen and Plaintiff amends the complaint or files a new suit, then Defendants may remove within 30 days of the new pleading, see 28 U.S.C. 1446(b)(3) (allowing 30 days after propriety of removal is ascertainable). Plaintiff's motion to remand #15 is granted, but no fees or costs will be assessed (as discussed during the hearing). The remaining state claims are remanded forthwith back to the Circuit Court of the 19th Judicial District, Lake County, Illinois. Civil case terminated in federal court and remanded.
