Filing 9 MINUTE entry before the Honorable Edmond E. Chang: In light of financial indigency, Plaintiff's motion #4 to proceed in forma pauperis is granted. The Clerk's Office shall terminate Janice Jackson as a Defendant and substitute the government entity, namely, Chicago Public School District 299. Summons shall issue as the Chicago Public School District 299. The Marshals Service shall use the USM-285 on file to serve the School District. For now, in light of the early stage of the case, the motion #5 for attorney representation is denied without prejudice. Plaintiff has some college education, and right now service of process is the next step. The Court does notify Plaintiff that there is almost surely a statute of limitations problem with the untimeliness of the complaint. After service of the summons and the complaint, almost surely Defendant will file a motion to dismiss on that basis, and it is probably in Plaintiff's best interest to make an appointment with the Pro Se Help Desk to get advice on that issue. See online at http://www.ilnd.uscourts.gov/Pages.aspx?page=ProSe for the Pro Se Help Desk information. The Court also alerts Plaintiff that an unsuccessful lawsuit might result in requiring payment of costs under Federal Rule of Civil Procedure 54(d)(1).
