Filing 8 MINUTE entry before the Honorable Edmond E. Chang: Plaintiff's motion #4 to proceed in forma pauperis is granted in part. Plaintiff reports that her spouse's income is $6,680 per month, which is a little over $80,000 per year. But no one in the household has more than $200 in a bank account. In light of the absence of cash on hand, the motion #4 is granted but conditioned on Plaintiff paying $50 toward the filing fee by 11/30/2018. In the meantime, the Marshals Service is appointed to serve the summons on Defendant, using the USM-285 form at R. 5. The Marshals Service may send a waiver of service to Defendant under Federal Rule of Civil Procedure 4(d). A status hearing is set for 12/11/2018 at 8:30 a.m., but only to track the progress of service and payment of the partial filing fee (no appearance is required). Emailed notice (slb, ) |
