Filing 15 MINUTE entry before the Honorable Gary Feinerman:Plaintiff's motion for reconsideration of order on non-party Hahn's motion to quash subpoena #10 is denied. Non-Party Hahn (the subpoena recipient) and Defendant Daikin Applied Americas (which caused the subpoena to issue) are content to have the deposition take place in Fort Wayne, Indiana, rather than Chicago, Illinois. Plaintiff Continental Insurance Company has no basis to object to the subpoena on the ground that, before modification #9 , it required Hahn to appear more than 100 miles from where he lived or worked; in any event, by failing to move to timely quash the subpoena on that ground, Plaintiff forfeited any such objection. This order and the 10/15/2018 order #9 do not prevent the District of Minnesota from precluding the parties from taking any further discovery; if the District of Minnesota enters such an order, then Defendant of course will be unable to take the deposition.
