ORDER: Plaintiff's application for leave to proceed in forma pauperis #3 is granted. The Court orders the trust fund officer at Plaintiff's place of incarceration to deduct $1.89 from Plaintiff's account for payment to the Clerk of Court as an initial partial payment of the filing fee, and to continue making monthly deductions in accordance with this order. The Clerk of Court shall send a copy of this order to the trust fund officer at the facility currently having custody of Plaintiff, who is reminded that deductions should be made as to each of Plaintiff's federal filing fees for which a balance remains in accordance with the Prison Litigation Reform Act, as explained below. Plaintiff's trust fund account statement does not appear to reflect such deductions as to Plaintiff's prior case. The Clerk of Court also is directed to: (1) file Plaintiff's complaint #1 ; (2) dismiss and terminate Defendants Williams, Tanner, Doe, and Obaisi without prejudice; (3) alter the caption to list Portwood as the lead Defendant; (4) issue summonses for service of the complaint on Defendants Portwood and Whitherspoon; and (5) send the U.S. Marshal a copy of the USM-285 forms for these Defendants that appear within Docket No. 5.
