Chang: Respondents' extension motion #8 to respond to the petition is granted, over Petitioner's objection, although no further extensions will be granted. It is apparent from the petition that there are state-court records that must be gathered and studied before Respondents can file a response. Neither the petition #1 nor the response on the extension motion #10 set forth how diligently, or not, Petitioner has raised the over-service issue. It was not until 09/27/2018 that the state court denied the motion to amend the mittimus, so that is a very recent development (and it seems unlikely that exhaustion of the state process would have finished before the filing of the petition on 10/08/2018).
