Filing 8 DESIGNATION of Kurt N. Lindland as U.S. Attorney for Defendant Commissioner of Social Security (Lindland, Kurt) |
Filing 7 MINUTE entry before the Honorable Virginia M. Kendall. Plaintiff Lakiesha Moore's application for leave to proceed in forma pauperis #3 is granted. Title 28 U.S.C. 1915(a) permits the Court to authorize Plaintiff to proceed in forma pauperis if she is unable to pay the mandated filing fee. The statute "is designed to ensure that indigent litigants have meaningful access to the federal courts." Neitzke v. Williams, 490 U.S. 319, 324 (1989). Plaintiff is eligible to proceed in forma pauperis if paying the filing fee would prevent her from purchasing the necessities of life. Zaun v. Dobbin, 628 F.2d 990, 992 (7th Cir. 1980). Plaintiff represents in her affidavit that she is not married and is not employed. (Dkt. #3 ). Plaintiff was last employed for one month in May 2018, at which time she earned a net monthly income of $2,200 as a home care provider. (Id.). She has since used this income to cover basic living expenses. (Id.). Plaintiff represents that she has not received any other income in the last twelve months, has less than $200 in cash or in a check or savings account, and owns no vehicle, real estate, or personal property worth more than $1,000. (Id.). She is currently living with family and friends who provide her with shelter and toiletries because she is struggling herself to make ends meet. (Id.). The Court finds Plaintiff has sufficiently demonstrated that she is unable to pay the fee and, therefore, grants Plaintiffs application for in forma pauperis status #3 . Mailed notice (lk, ) |
