Filing 10 ENTERED JUDGMENT Mailed notice(gel, ) |
Filing 9 ORDER Signed by the Honorable John Robert Blakey on 12/13/2018: By order dated October 30, 2018 #8 , the Court denied Plaintiff's application to proceed in forma pauperis and directed her to either file a properly supported renewed motion or pay the full statutory $400 filing fee. Although the Court warned Plaintiff that failure to comply by November 21, 2018, would result in summary dismissal of this case, she did not respond. Nor did she otherwise communicate with the Court. Accordingly, this case is dismissed without prejudice based on Plaintiff's failure to comply with the October 30, 2018 order. Having brought this action, Plaintiff remains obligated to pay the full filing fee. See 28 U.S.C. 1915(b)(1). The Clerk is directed to enter a final order of dismissal. This case is closed. Filing 8 ORDER: Plaintiffs applications for leave to proceed in forma pauperis #4 #5 are denied without prejudice. If Plaintiff wants to pursue this case, by November 21, 2018, she must either: (1) pay the full statutory filing fee of $400; or (2) submit a renewed application for leave to proceed in forma pauperis that (a) is fully and accurately completed; (b) is certified by trust fund officers at all facilities where she was incarcerated starting six months prior to submission of her complaint; (c) attaches copies of her trust fund statements showing activity in her accounts at those facilities for this period; and (d) discloses her present financial situation now that she has been paroled. If Plaintiff fails to comply, the Court will summarily dismiss this case. Plaintiff's motion for attorney representation #6 is denied without prejudice. Plaintiff indicates that she asked the public defender's office to represent her, but the public defender does not represent individuals in civil lawsuits, and, in any event, it is too early to determine if counsel is appropriate. Plaintiff is advised that she must promptly submit a change-of-address notification if her address changes again. If she does not promptly advise the Clerk of any changes in her address, this case will be subject to dismissal. The Clerk is directed to send Plaintiff an application for leave to proceed in forma pauperis. Signed by the Honorable John Robert Blakey on 10/30/2018. Mailed notice (eaa, ) |
