Filing 6 MINUTE entry before the Honorable Virginia M. Kendall. Plaintiff Amiria Shakur's application for leave to proceed in forma pauperis #4 is granted. Title 28 U.S.C. 1915(a) permits the Court to authorize Plaintiff to proceed in forma pauperis if she is unable to pay the mandated filing fee. The statute "is designed to ensure that indigent litigants have meaningful access to the federal courts. Neitzke v. Williams, 490 U.S. 319, 324 (1989). Plaintiff is eligible to proceed in forma pauperis if paying the filing fee would prevent her from purchasing the necessities of life. Zaun v. Dobbin, 628 F.2d 990, 992 (7th Cir. 1980). Plaintiff represents in her affidavit that she is not married and has four children ages four, three, two and seven months that depend on her for support. (Dkt. #4 ). Plaintiff represents that she is currently employed at Checkers, where she works approximately 17-34 hours per week earning $11 per hour, or approximately $9,724 to 19,448 annuallywell below the 2018 poverty guideline for a family of five of $29,420. (Id.; see also https://aspe.hhs.gov/poverty-guidelines). Plaintiff also owns a vehicle worth $1,266 and in the last twelve months has received $579 each month ($6,948 total) in food stamps. (Id.). Plaintiff represents that neither she nor anyone else who lives in the same residence (presumably, only her children) has received any other income in the last year, owns any real estate or other personal property worth more than $1,000, or has more than $200 in cash or in a checking or savings account. (Id.). The Court finds Plaintiff has sufficiently demonstrated that she is unable to pay the fee and, therefore, grants Plaintiffs application for in forma pauperis status #4 . Mailed notice (lk, ) |
