Filing 8 COMPLAINT filed by Shannon Madera. (tt, ) |
Filing 7 MINUTE entry before the Honorable Virginia M. Kendall. Plaintiff Shannon Madera's application for leave to proceed in forma pauperis #4 is granted. 28 U.S.C. 1915(a) permits the Court to authorize Plaintiff to proceed in forma pauperis if she is unable to pay the mandated filing fee. The statute "is designed to ensure that indigent litigants have meaningful access to the federal courts." Neitzke v. Williams, 490 U.S. 319, 324 (1989). Plaintiff is eligible to proceed in forma pauperis if paying the filing fee would prevent her from purchasing the necessities of life. Zaun v. Dobbin, 628 F.2d 990, 992 (7th Cir. 1980). Here, Plaintiff represents in her affidavit that she has not been employed since 2014, at which point she was working for the Hilton Garden Inn and earning $9/hour plus tips. (Dkt. #4 ) at 1. She further represents that she is married but separated and her spouse is not currently employed. She does not have any dependents. Id. at 13. According to the affidavit, in the last twelve months, Plaintiff has not received income from any source. Id. at 2. Although Plaintiff reports having $500.00 in a checking account, she does not own any real estate, automobiles or other personal property worth more than $1000. Id. at 1, 3. As such, payment of the filing fee in this action would substantially deplete the very little funds Plaintiff has reported and would prevent her from purchasing the necessities of life. Finally, Madera seeks to challenge a denial of Supplemental Social Security Income disability benefits. Considering these factors, the Court finds Plaintiff has sufficiently demonstrated that she is indigent and unable to pay the fee and, therefore, grants her application for in forma pauperis #4 status. Mailed notice. (lk, ) |
