This matter was dismissed without prejudice on March 7, 2019, for Plaintiff's failure to comply with the Court's previous Order. Later that day, this motion was received. If Plaintiff seeks to proceed with this lawsuit he still must either submit a properly completed application to proceed in forma pauperis, including supporting documents, or pay the Court's $400.00 filing fee. In addition, he must also submit an amended complaint. The matter will remain closed at this time and may be reinstated if Plaintiff fully complies with the Court's previous Order. March 7, 2019 Opinion or Order Filing 7 ORDER: By order dated 12/26/18, the Court denied Plaintiff's application for leave to proceed in forma pauperis without prejudice and ordered Plaintiff to either submit a properly completed application, including supporting documents, or pay the Court's $400.00 filing fee. [Dkt. 5]. The Court also dismissed the complaint without prejudice and gave Plaintiff leave to submit an amended complaint. [Id.] At that time, the Court warned Plaintiff that failure to comply by 2/11/19, would result in summary dismissal of this case. [Id.] Plaintiff has not submitted a renewed application for leave to proceed in forma pauperis, nor paid the Court's filing fee, nor has he submitted an amended complaint to date. Accordingly, this case is dismissed without prejudice for Plaintiffs failure to comply with the Court's order. The Court directs the Clerk of Court to terminate all pending motions as moot. December 26, 2018 Opinion or Order Filing 5 ORDER: Plaintiff's application for leave to proceed in forma pauperis #3 is denied without prejudice. In addition, Plaintiff's complaint is dismissed without prejudice. If Plaintiff wishes to pursue this litigation, by February 11, 2019, he must: (1) pay the full statutory filing fee of $400 or submit a renewed application for leave to proceed in forma pauperis using the Court's form and (2) submit an amended complaint complying with the instruction contained in this order. If Plaintiff fails to comply with this order the Court will summarily dismiss this case. The Clerk is directed to send Plaintiff an application for leave to proceed in forma pauperis, an amended civilrights complaint form with instructions, a blank USM-285 service form, and a copy of this order.
