Plaintiffs Christopher Stoller and Michael Stoller, as well as Michael Stoller's father and legal guardian Leo Stoller, were present in court. Christopher Stoller's motion to consolidate #8 is voluntarily withdrawn. Although Christopher Stoller stated in open court that Michael Stoller is not a party to this case, review of the complaint reveals that Michael Stoller is indeed a pro se plaintiff in this case. The Court takes judicial notice of the fact that Michael Stoller has been judicially determined to be incompetent and that a guardian, Leo Stoller, has been appointed on his behalf. It accordingly appears that Michael Stoller lacks the capacity to proceed as a plaintiff in this action. 755 ILCS 5/11a-18(c). The Court notes that in a separate case before it, Leo Stoller appeared through counsel and substituted himself as the plaintiff following the determination of Michael Stoller's incompetence. The Court accordingly directs Michael Stoller's guardian Leo Stoller, who was present in Court, to appear through counsel and move for leave to substitute himself as the plaintiff in this action. If such a motion is not received by 12/28/2018, Michael Stoller will be dismissed from this action without prejudice in light of his incompetence. Mailed notice. (ym, ) |
