Filing 8 COMPLAINT filed by Stacy Perez; Jury Demand. (gcy, ) Text Modified on 11/8/2018 (gcy, ). |
Filing 7 MINUTE entry before the Honorable John Z. Lee: Plaintiff has filed a complaint #1 and an application for leave to proceed in forma pauperis #4 . Plaintiff's IFP application demonstrates that she cannot prepay the filing fee, and the application is thus granted. Additionally, the Court has conducted an initial review of Plaintiff's complaint and determined that it satisfies the requirements of 28 U.S.C. 1915(e)(2)(B). See Turley v. Rednour, 729 F.3d 645, 649 (7th Cir. 2013). Accordingly, the Clerk of Court is directed to: (1) file Plaintiff's complaint; (2) issue summonses for service of the complaint on Defendants; and (3) mail Plaintiff a copy of this order, as well as 26 blank USM-285 (Marshals service) forms. The U.S. Marshal is appointed to serve Defendant but will not attempt service until Plaintiff returns completed USM-285 service forms. Plaintiff must return the completed USM-285 forms to the Clerk of Court by 12/7/18. Her failure to do so may result in the dismissal of this case for lack of prosecution. An initial status hearing is set for 1/9/19 at 9:00 a.m.. Plaintiff's motion for attorney representation #5 is denied without prejudice given the early stage of the case and Plaintiff's apparent ability to present her claims logically and coherently. See Romanelli v. Suliene, 615 F.3d 847, 852 (7th Cir. 2010) (approving of district court's decision not to recruit counsel where the case was still in its "infancy" and none of the defendants had filed an answer).
