Filing 9 ORDER: Plaintiff has submitted supplemental trust fund information. Accordingly, his application for leave to proceed in forma pauperis #5 , supplemented with trust fund account information provided in #8 , is granted. The initial partial filing fee is waived. The Court orders the trust fund officer at Plaintiff's place of incarceration to make monthly deductions in accordance with this order. The Court directs the Clerk of Court to send a copy of this order to the trust fund officer of the facility having custody of Plaintiff. However, Plaintiff's complaint is dismissed on initial review pursuant to 28 U.S.C. 1915A. Dismissal is without prejudice to Plaintiff pursuing state-law remedies in an appropriate forum or a writ of habeas corpus at an appropriate time. Because Plaintiff's complaint does not state a claim upon which this Court may grant relief and he fails to state a claim against a non-immune Defendant, this dismissal counts as one of Plaintiff's three allotted dismissals under 28 U.S.C. 1915(g). This case is terminated. Civil case terminated. Signed by the Honorable Virginia M. Kendall on 1/11/2019. (See Statement). Mailed notice (yap, ). |

Filing 7 ORDER: Plaintiff's second application for leave to proceed in forma pauperis #5 is denied as incomplete for the reasons set forth below. By January 9, 2019, Plaintiff is given a final opportunity to either: (1) pay the full statutory filling fee of $400.00; or (2) submit a completed application for leave to proceed in forma pauperis that provides accurate financial information for the period specified. Failure to do so by that date will result in summary dismissal of this case. The Clerk is directed to forward a copy of this order to the trust fund office at Stateville Correctional Center to facilitate the process of obtaining the necessary financial information to resolve Plaintiff's fee status. The Court defers screening Plaintiff's complaint until Plaintiff's fee status is resolved. The Clerk of the Court is further directed to send Plaintiff an application for leave to proceed in forma pauperis, along with a copy of this order. Plaintiff's motion for attorney representation #6 is denied without prejudice to renewal once Plaintiff's fee status is resolved. (See Statement). Signed by the Honorable Virginia M. Kendall on 12/12/2018. Mailed notice (yap, ) |
