Filing 8 MINUTE entry before the Honorable John Robert Blakey: On 11/19/18, Plaintiff submitted a pro se complaint #1 , along with an application for leave to proceed in forma pauperis #4 , and a motion for attorney representation #5 . Plaintiff's complaint alleges that her employer discriminated against her on or about, or beginning on or about, 11/7/15. See #1 , 6. She further alleges that she filed a complaint of employment discrimination and received a final agency decision on 4/22/18. See #1 , 7.2(b). Absent equitable tolling, a Title VII suit against the federal government must be filed within 90 days of the Plaintiff's actual receipt of a final agency decision. 42 U.S.C. 2000e16(c); 29 C.F.R. 1614.407; Elmore v. Henderson, 227 F.3d 1009, 101011 (7th Cir. 2000). Although Plaintiff did not attach a copy of the final agency decision to her complaint, her allegations concerning the issuance of the final agency decision show that she initiated this lawsuit almost four months too late. And nothing in her complaint suggests that equitable tolling would apply. As a result, her claim is timebarred, and this case is dismissed. Plaintiff's application for leave to proceed in forma pauperis #4 and her motion for attorney representation #5 are denied. Civil case terminated. Mailed notice (gel, ) |
