| Filing 19 MINUTE entry before the Honorable Jeffrey T. Gilbert: Case called for show cause hearing. Defense counsel appeared. No one appeared for Respondent Metropolitan Institute of Pain, Inc. Defense counsel represented that Metropolitan produced three pages of documents in response to the subpoena served upon it by Defendant Thunder but counsel does not believe based on Plaintiff Brown's testimony that those three pages comprise all documents in Metropolitan's possession, custody, or control that would be responsive to the subpoena. The Court also reviewed the documents produced which appear to indicate Plaintiff Brown was treated at Respondent Metropolitan on two occasions in 2015 and 2016. The rule to show cause hearing is continued to 2/6/19 at 9:45 a.m. Respondent Metropolitan Institute of Pain, Inc. shall appear at that hearing and state why it should not be held in contempt of court for failure to comply fully with Defendant Thunder's subpoena. If Respondent Metropolitan does not appear at that hearing or produce all responsive documents in its possession, custody, or control that are responsive to Defendant Thunder's subpoena and certify in writing that it has done so, it faces the possible imposition of sanctions for failure to fully comply with the subpoena including potential payment of civil penalties and Defendant Thunders attorney fees.
