Plaintiff's counsel reported that the registered agent for the now defunct Defendant Blatt Hasenmiller law firm waived service by email. Plaintiff shall promptly file the proof of service. With regard to Plaintiff and the Midland Defendants, for now discovery will proceed on the merits of Plaintiff's individual claims, with a litigation hold as to the proposed class. Mandatory Initial Discovery Pilot Project disclosures due 02/19/2019. ESI discovery shall be disclosed by 04/01/2019. The first-round of written discovery requests (again, on the merits of the individual Plaintiff's claims) must be issued not later than 03/05/2019. Fact discovery shall close by 11/05/2019. Subpoenas may be issued immediately to Blatt, Hasenmiller, Leibsker & Moore, its former lawyers, or anyone else to preserve and obtain relevant records. The Midland Defendants' motion to compel arbitration due 02/05/2019. Plaintiff's response to the motion to compel due 03/05/2019. Defense reply due 03/19/2019. If Plaintiff believes that discovery is needed in order to respond to the motion to compel, then Plaintiff shall file a motion for discovery by 02/20/2019.
