Filing 11 AMENDED complaint by Cornelia Watson (bg, ) |
Filing 10 ORDER: In an Order dated 12/04/18 #8 , the Court granted Plaintiff's application to proceed in forma pauperis ("IFP") #4 but dismissed her complaint, brought pursuant to 42 U.S.C. 1983, for failure to state a claim. Plaintiff has now filed an amended complaint premised on 42 U.S.C. 1981 #9 that states a colorable claim and survives screening under 28 U.S.C. 1915, the federal statute governing IFP applications. Accordingly, the United States Marshals Service is appointed to serve Defendant. The Clerk shall issue summonses for service of the complaint by the U.S. Marshal on the Defendant. The Clerk is directed to mail Plaintiff two blank USM-285 forms. The U.S. Marshal will not attempt service on Defendant unless and until the required forms are received from Plaintiff. Plaintiff must therefore complete and return the forms to the U.S. Marshal within thirty days of the date of this order. The U.S. Marshal is directed to make all reasonable efforts to serve Defendant. Signed by the Honorable John J. Tharp, Jr on 1/22/2019. Mailed notice. (bg, ) |

Filing 8 ORDER: For the reasons set forth in the Statement below, the Court grants the plaintiff's application for leave to proceed in forma pauperis #4 . The plaintiff may proceed without prepayment of the filing fee. The Court finds, however, that the complaint fails to state a colorable federal claim. The complaint is therefore dismissed without prejudice. Any amended complaint must be filed by January 4, 2019. See statement for details. Signed by the Honorable John J. Tharp, Jr on 12/4/2018. Mailed notice. (ew, ) |
