Filing 16 MINUTE entry before the Honorable Edmond E. Chang: Status and motion hearing held. Plaintiffs' counsel represents that Plaintiffs are citizens of the state of California, which is the state of their domicile. The subject matter jurisdiction inquiry has been satisfied. On Defendants' motion #11 for judgment on the pleadings, Plaintiffs' response is due by 01/28/2019 and Defendants' reply is due by 02/19/2019. Filing 15 MINUTE entry before the Honorable Edmond E. Chang: The Court has reviewed the notice of removal, R. 1, and issues the following jurisdictional inquiry. Defendants rely on diversity jurisdiction, 28 U.S.C. 1332, in their notice of removal, R. 1, para. 6, for subject matter jurisdiction. Defendants allege that Defendant CL Holdings is a corporation organized in the Cayman Islands with its principal place of business in the Cayman Islands. Id., para. 8. Defendants then allege that Defendant EFI Global, Inc. is a corporation organized in Delaware with its principal place of business in Texas. Id., para. 9. But the complaint alleges that "Plaintiffs are residents of California." Id., para. 7. Defendants have failed to properly allege subject matter jurisdiction because the citizenship of partiesas distinct from mere residencyis what matters. Hunter v. Amin, 583 F.3d 486, 491 (7th Cir. 2009). At the status hearing, the parties should be prepared to confirm that Plaintiffs are *citizens* of California.Emailed notice (eec) |
