Following review of the parties' joint submission and oral argument, the Court makes the rulings described herein. As discussed in open court, the parties are to comply with this Court order on or before 3/29/19. A status hearing is set for 4/22/19 at 9:30 a.m. to monitor the parties' progress in discovery. 1) Defendants are ordered to produce unredacted versions of the contractual agreements between BSN and Stimmel, Stimmel's offer letter from BSN, and the BSN non-compete, but need not produce any drafts of those documents. 2) Defendants must identify the customer for which Stimmel has responsibility at BSN, and must produce any documents in their possession, custody, or control regarding customers that Stimmel planned to contact on behalf of BSN before the litigation was initiated, or certify that no such documents exist. 3) Defendants are ordered to compel the discovery sought in the joint discovery report relating to Stimmel's solicitation of current or former Riddell employees (Dkt. 78 at 6), and Defendants' objections that the terms in Plaintiff's discovery requests are vague and overly broad are overruled. 4) Defendants are ordered to produce 30(b)(6) witnesses on the topics listed in the joint discovery report (Dkt. 78 at 8-9). However, the Defendant must only produce a 30(b)(6) witness for the "steps taken by BSN to sunre that it did not come into possession of confidential, proprietary, or trade secret information belonging to Riddell" that has knowledge of the human resources "onboarding" process that Plaintiff's counsel described during the discovery conference. 5) The Court does not believe that redactions based on proprietary information or personal information within otherwise relevant documents is appropriate, and orders that unredacted versions of any such documents be produced by Defendants. 6) Plaintiff is ordered to produce correspondence to Defendants identifying the general nature of the documents Plaintiff is withholding from production pursuant to FRCP 34(b)(2)(C) and the specific reason that those documents are being withheld. 7) Plaintiff is ordered to certify that the final purchase agreement with Kollegetown has been produced, and to produce an unredacted version of the Sales Representative and Employment Agreements of KollegeTown's key customer interfacing sales representatives, as referenced in the Handlen Declaration. The Court denies without prejudice Defendants' request for communications relating to the key employees named in any agreement with KollegeTown. 8) Plaintiff has a duty to specifically identify what confidential information it is seeking to protect in this action, and the Court does not believe that producing Stimmel's email inbox in its entirety without more is sufficient to meet that obligation. Therefore, the Court orders that the Plaintiff identify what information it considers confidential, either by designating specific documents or through a narrative that is narrowly tailored in a way that allows the Defendants to cull Stimmel's inbox in a targeted manner to find documents that might include confidential information Plaintiff seeks to protect. 9) Plaintiff must produce 50 invoices from Stimmel's customers while at Riddell that predate the KollegeTown acquisition. Given Plaintiff's representation in open court that they are only claiming near-permanent customer status on the 715 customer accounts for which Stimmel was responsible, Plaintiff's objections to Defendants' requests for document numbers 22, 23, 25, and 28 discussed in the joint discovery report are sustained. 10) Plaintiff is ordered to produce specific examples within each category of confidential information mentioned in the Handlen Declaration, and may not simply rely on its production of Stimmel's inbox as an adequate response to Defendants' requests for production numbers 14, 16, and 17. 11) Plaintiff's objections to Defendants' request for production number 19 are sustained.
