The Court extends the existing fact discovery date in this case by 45 days so that fact discovery now will close on 8/31/20. The Court declines Defendants' invitation to strike all discovery dates and not reset them in light of Plaintiff's failures to respond to written discovery and Plaintiff's counsel's failure to appear for noticed depositions, the latter because of a member of Plaintiff's counsel's family ostensibly tested positive for the COVID-19 virus. The remedy for Plaintiff's defaults, in the Court's view, is not to punt all dates into the stratosphere. If Plaintiff will not comply with Defendants' discovery requests, prior Court orders concerning Plaintiff's obligation to respond to discovery, or participate reasonably in deposition practice, then there are other remedies available to Defendants and the Court besides striking all existing discovery dates. Further, the parties should consider taking depositions by remote means pursuant to Rule 30(b)(4) of the Federal Rules of Civil Procedure in light of the COVID-19 pandemic. That would obviate the need for Plaintiff's counsel to appear for depositions in person. The Court notes Defendants do not say in their Motion #93 that Plaintiff's counsel contracted the COVID-19 virus; only that a member of his family tested positive. For clarification and the avoidance of doubt, this order should NOT be interpreted as requiring Plaintiff's counsel to participate in depositions, in person or by remote means, if he is not healthy enough to do so or if caring for a sick family member precludes him from doing so.
