July 26, 2021 Filing 163 MINUTE entry before the Honorable Martha M. Pacold: Defendants have filed a motion to voluntarily dismiss their counterclaims with prejudice #128 . Although Plaintiff initially indicated that it opposed this motion, see #128 8, Plaintiff did not file an opposition brief or request an extension of time in which to file such a brief, despite being given the opportunity to do so, see #133 . This failure amounts to waiver of any arguments Plaintiff might have raised in opposition to Defendants' motion to dismiss. See Ennin v. CNH Indus. Am., 878 F.3d 590, 596 (7th Cir. 2017) ("Where a brief is permitted as a matter of right a party must file it or risk waiver of any arguments it has neglected to raise"); cf. United States v. Thompson, 286 F.3d 950, 970 (7th Cir. 2002) (holding that a litigant "waived" argument where he "did not even file a reply brief"). Accordingly, Defendants' motion to voluntarily dismiss their counterclaims with prejudice #128 is granted. Mailed notice (ntf, )

The parties apparently have agreed that Plaintiff's expert will be deposed on 3/3/21 and that Defendants' expert disclosure will be made on 3/10/21 #147 . The parties shall comply with those dates absent a court order varying them. The Court notes that Plaintiff apparently has not been cooperating in the filing of the joint reports the court has ordered the parties to file #144 #147 . The Court orders the filing of joint status reports to avoid disagreements and unnecessary delay required to resolve them. If Plaintiff continues to avoid participating in the filing of required joint status reports, he will have no standing to challenge reports filed by Defendants. To the extent the parties disagree with respect to matters covered by a joint report, the report should contain both parties' positions. Mailed notice (ber, )

August 21, 2020 Filing 110 MINUTE entry before the Honorable Jeffrey T. Gilbert: Plaintiffs' Request for Instructions #109 is granted. The Court strikes the names of the lawyers erroneously included on the signature page of Plaintiff's Motion to Compel Defendants to Answer Discovery and Supplement Discovery Responses #107 . Plaintiff's Motion to Compel Defendants to Answer Discovery and Supplement Discovery Responses #107 otherwise stands as is and the briefing schedule set on Motion also remains the same. Defendants need not respond to Plaintiff's Request for Instructions #109 and the Court considered this issue resolved. Mailed notice (ber, )
August 20, 2020 Filing 109 MOTION by Plaintiff Gilberto Zambrano Request for instructions to either strike a pleading or file an amended motion to compel. (Hanlon, Robert)
August 19, 2020 Filing 108 MINUTE entry before the Honorable Jeffrey T. Gilbert: Plaintiff's Motion to Compel Defendants to Answer Discovery and Supplement Discovery Responses #107 is set for hearing on 8/25/20 at 10:30 a.m. which is a previously set hearing date in this case #104 . Defendants shall respond to Plaintiff's Motion to Compel #107 by noon on 8/24/20. Defendants need not respond to Plaintiff's Motion with respect to any of Defendants' interrogatory responses because Plaintiff does not articulate in his Motion #107 which interrogatory responses Plaintiff believes are deficient. See Motion #107 at para. 9 ("Plaintiff does not seek answers to interrogatory [hashtag symbol])." Defendants' response to Plaintiff's Motion, among other things Defendants wish to address, should address the sufficiency of their production of documents in response to those requests for production ("RFPs") as to which they agreed to produce documents (RFPs 1, 2, 3, 7, 11) and their objections to those of Plaintiff's RFPs as to which Defendants said they would not be producing any documents (RFPs 4, 6, 8, 9, 10, 13). Finally, the Court notes that Plaintiff lists lawyers at Ungaretti & Harris on his Motion #107 at page 3 as "Attorneys for Plaintiff." The Chicago law firm, Ungaretti & Harris, merged with Nixon Peabody years ago and currently does business under that name, and one of the attorneys listed in the Ungaretti & Harris signature block passed away in 2017. The Court assumes this is an error by Plaintiff's counsel. No attorney other than Robert Thomas Hanlon has filed an appearance in this case for Plaintiff. Mailed notice (ber, )

The Court does not know who noticed the deposition of Jen Keane and the Notice does not say. Mailed notice (ber, )

August 12, 2020 Filing 100 MINUTE entry before the Honorable Jeffrey T. Gilbert: The Court has reviewed the parties' Joint Status Report #99 . The telephone status hearing set for 8/13/20 is stricken and reset to 9/17/20 at 10:30 a.m. because nothing has happened in this case since the Court ruled on Defendants' Motion for Extension of Time to Complete Discovery #94 #98 . Per the Court's last order, fact discovery closes in this case on 8/31/20 #98 . By 8/14/20, Defendants shall file a notice of confirmed dates for the depositions of Plaintiff and third-party witness Ms. Alvarez to be taken before the close of fact discovery. The notice also shall include confirmed dates for any other depositions that either party will take before the close of fact discovery. If Plaintiff or Ms. Alvarez, or anyone else, already have been deposed by 8/14/20, then Defendants' notice shall so state. The previously set date of 9/14/20 #98 for the parties to file a report with proposed dates for either side to make expert disclosures stands. August 10, 2020 Filing 99 STATUS Report by Red Dot Management, LLC, Sparkplug Capital, LLC (Phillips, James)
July 15, 2020 Filing 98 MINUTE entry before the Honorable Jeffrey T. Gilbert: The motion hearing noticed for 7/16/20 is stricken. Defendants' Motion to Extend Discovery and to Extend the Time for Submitting Proposed Expert Disclosure Deadlines #93 is granted in part and denied in part. The Court extends the existing fact discovery date in this case by 45 days so that fact discovery now will close on 8/31/20. The date for the parties to file a report with dates for their respective expert disclosures, if any, likewise is extended by 45 days to 9/14/20. The Court declines Defendants' invitation to strike all discovery dates and not reset them in light of Plaintiff's failures to respond to written discovery and Plaintiff's counsel's failure to appear for noticed depositions, the latter because of a member of Plaintiff's counsel's family ostensibly tested positive for the COVID-19 virus. The remedy for Plaintiff's defaults, in the Court's view, is not to punt all dates into the stratosphere. If Plaintiff will not comply with Defendants' discovery requests, prior Court orders concerning Plaintiff's obligation to respond to discovery, or participate reasonably in deposition practice, then there are other remedies available to Defendants and the Court besides striking all existing discovery dates. Further, the parties should consider taking depositions by remote means pursuant to Rule 30(b)(4) of the Federal Rules of Civil Procedure in light of the COVID-19 pandemic. That would obviate the need for Plaintiff's counsel to appear for depositions in person. The Court notes Defendants do not say in their Motion #93 that Plaintiff's counsel contracted the COVID-19 virus; only that a member of his family tested positive. For clarification and the avoidance of doubt, this order should NOT be interpreted as requiring Plaintiff's counsel to participate in depositions, in person or by remote means, if he is not healthy enough to do so or if caring for a sick family member precludes him from doing so. This case is set for a telephonic status hearing on 8/13/20 at 10:00 a.m. The call-in number is 877-336-1829, access code 1022195. The parties shall file by 8/10/20 a joint status report on the status of discovery including confirmed dates for the depositions any party will take before the close of fact discovery. Defendants shall prepare the first draft of the status report and send it to Plaintiff's counsel by 8/5/20. If Plaintiff will not cooperate in preparing the joint status report, then Defendants should file that report on their own behalf. If Defendants wish to file any motion(s) to address Plaintiff's failures with respect to written or oral discovery, nothing in this order prevents them from doing so. Mailed notice (ber, )
