Filing 13 MINUTE entry before the Honorable Harry D. Leinenweber: Plaintiff's motion for appointment of counsel #8 is denied without prejudice. First, the Court cannot appoint an attorney in a civil matter without a showing that Plaintiff is unable to afford the services of an attorney. 28 U.S.C. 1915(e)(1). If Plaintiff seeks to refile a motion for representation, Plaintiff must also submit an In Forma Pauperis Application and Financial Affidavit ("IFP Petition"). Plaintiff can obtain the IFP Petition from the Clerk's office or from the Northern District of Illinois website. Second, the Court cannot appoint an attorney without a showing that Plaintiff has made a reasonable attempt to obtain counsel or has been effectively precluded from doing so. Pruitt v. Mote, 503 F.3d 647, 654 (7th Cir. 2007). Accordingly, if Plaintiff chooses to refile for attorney representation, he should use the Motion for Attorney Assistance form. Plaintiff can obtain this form from the Clerk's office or from the Northern District of Illinois website. Plaintiff may refile an amended Motion for Attorney Assistance, along with an IFP Petition, by 3/18/19. Defendants Dale Santerelli and Latasha Chandler's Motion to Dismiss #9 and Defendants Correct Care Solution, LLC and Young Kim's Motion to Dismiss #11 are both entered and continued until after Plaintiff has been given an opportunity to secure council. If Plaintiff fails to do so he will proceed pro se and the Court will then consider the motions to dismiss. Parties need not appear on 2/27/2019. Mailed notice (maf) |
