March 19, 2019 Filing 16 MINUTE entry before the Honorable Edmond E. Chang: Status hearing held. Counsel reported on the status of settlement negotiations: Plaintiff and Advocate are still in discussions amongst themselves, and will probably ask the magistrate judge for a couple more weeks to decide whether to ask for a formal conference. For the past couple of weeks, Advocate's counsel has been discussing representation of the individual Defendants with Aramark's counsel (Owens is a current employee, and Johnson was employed with Aramark during the relevant time). Plaintiff might voluntarily dismiss the individual Defendants. To absolutely guarantee that the individual Defendants are not an obstacle to a definitive resolution of the case, the Court directs the Clerk of Court to issue summons for service on Defendants William Johnson and Robert Owens. Plaintiff shall promptly mail waivers of summons to the two individual Defendants, either to Aramark's counsel (if counsel represents that counsel can waiver service on their behalf) or directly to the individuals. If Aramark's counsel cannot accept service for the individual Defendants, then Aramark shall provide a last known address for the individuals. Response to the waivers due no later than 04/18/2019. The Court urges Defendants to consider waiving service, because a refusal to waive service triggers a requirement that Defendants pay the costs of service. Fed. R. Civ. P. 4(d)(2). Chang: Plaintiff's attorney, Lana Nassar, called the courtroom deputy to report that the parties are jointly requesting a settlement referral to the magistrate judge. The referral will be processed with the Executive Committee. But for now the status hearing of 03/19/2019 remains in place, as does the status report requirement, because the Court wants to ensure that the individual Defendants are served and to determine whether Advocate's defense counsel also will represent the individuals.
