Filing 5 ORDER signed by the Honorable Edmond E. Chang. For the reasons stated in the Order, Plaintiff's application to proceed in forma pauperis #3 is granted. The Court orders the trust fund officer at Plaintiff's place of incarceration to deduct $37.70 from Plaintiffs account for payment to the Clerk of Court as an initial partial payment of the filing fee and to continue making monthly deductions in accordance with this order. At this point, ***100%*** of the monthly deposits must be transmitted to the Clerk in light of the number of in forma pauperis cases filed by Plaintiff. The Court directs the Clerk of Court to send a copy of this order to the trust fund officer of the facility having custody of Plaintiff. Plaintiff's complaint is dismissed for the reasons explained in the Order. First, the dismissal is with prejudice on any claim that accrued before 11/06/2017. It is without prejudice as to any claim related to the alleged failure to honor the single-cell permit that accrued after that date. If Plaintiff wants to proceed with this case, then he must submit a proposed amended complaint by 04/30/2019. Failure to do so will result in dismissal of this case in its entirety with prejudice for failure to state a claim. Plaintiff also must promptly submit a change-of-address notification if he is transferred to another facility or released. If Plaintiff fails to keep the Court informed of his address, this action will be subject to dismissal for failure to comply with a Court order and for failure to prosecute. Plaintiff's motion for attorney representation #4 is denied without prejudice. The Clerk is directed to provide Plaintiff with an amended civil rights complaint form and instructions along with a copy of this order.
