Filing 5 ORDER: Plaintiff's application for leave to proceed in forma pauperis #3 is granted. The Court orders the trust fund officer at Plaintiff's place of incarceration to immediately deduct $6.66 from Plaintiff's account for payment to the Clerk of Court as an initial partial payment of the filing fee in this case. As discussed below, the Court also orders Plaintiff to pay (and the facility having custody of him to automatically collect and remit) to the Clerk of Court, 40% of any and all deposits to Plaintiffs account until his filing fees have been paid in full. Summonses, however, shall not issue.Plaintiffs complaint #1 is dismissed as frivolous. This dismissal counts as one of Plaintiff's three allotted dismissals under 28 U.S.C. 1915(g). The dismissal, however, is without prejudice to Plaintiff pursuing any challenges he may have to the state-court proceedings before a proper tribunal.
