The parties report that written discovery is ongoing, that they have exchanged almost 1,900 individual written discovery requests, and that they anticipate taking approximately 260 fact depositions (plaintiff anticipates 50, defendants anticipate 210). The parties also report that plaintiff is not interested in a global settlement conference at this time. Given the potential volume of third-party discovery in this matter, the Court encourages the parties to issue any third-party document subpoenas as soon as possible, and indeed will set a deadline for that at the appropriate juncture. The parties are directed to submit another joint status report by 2/3/22 addressing the following subjects: (1) the status of written discovery among the parties, including any unresolved written discovery disputes (upon which the parties should meet and confer ahead of time); (2) the status of third party discovery, including a chart of all document subpoenas issued by the parties, to whom issued, when issued, and the status of those subpoena responses; (3) a list of witnesses each party seeks to depose, and the anticipated timeframe or order for taking those depositions in advance of the 9/16/22 fact discovery close. Moreover, given the volume of depositions the parties anticipate in this matter, and proportionality concerns, the Court is considering imposing aggregate time limits on the depositions each party may take (i.e., a total number of hours that plaintiff and each individual defendant can use for all of their depositions). In their JSR, the parties should explain their positions on such time limits and should further discuss what kind of time limits would be appropriate in this matter, should time limits be imposed. The Court construes Defendants' request in the status report that discovery be bifurcated as a motion, which it takes under advisement. As discussed in open court, the Court declines to set a discovery schedule, including a due date(s) for the exchange of initial disclosures, until the bifurcation request is resolved. Instead, the Court directs the parties to brief the issue of bifurcation of discovery and their corresponding requests for an appropriate discovery schedule. Defendants' combined memorandum of law in support of their motion to bifurcate is due by 7/15/21 and may be reasonably oversized given the issues discussed on the record, and Plaintiff's response is due by 8/10/21. To the extent any Defendant seeks leave to file its own separate brief addressing bifurcation issues and/or arguments unique to that defendant, they may seek leave to do so by 6/30/21. The Court will set a deadline for initial disclosures and for a further telephonic status conference upon determination of the issue of bifurcated discovery. As discussed further in open court, the Court encourages any Defendant who seeks information from Plaintiff in order to consider the possibility of settlement to reach out to Plaintiff to request that information at this time. Filing 348 MINUTE entry before the Honorable John F. Kness: Before the Court is Plaintiff's motion for entry of default against Defendant The Ferrell Agency, Inc. ("Ferrell") #330 . Ferrell has failed to either plead or to otherwise appear to defend against this action, despite Plaintiff's multiple attempts at service. Rule 4 of the Federal Rule of Civil Procedure permits service of a foreign corporation under the rules of that corporation's state of domicile. Fed. R. Civ. P. 4(h)(1)(A). In West Virginiathe state where Ferrell is domiciledservice of a summons and complaint on a domestic private corporation is accomplished "by delivering or mailing... a copy [of the summons and complaint] to any agent or attorney in fact authorized by appointment or statute to receive or accept service in [sic] its behalf." W. Va. R. Civ. P. 4(d)(5)(B). As Plaintiff explains in its motion, it made multiple attempts to serve Ferrell in accordance with West Virginia service rules at the business addresses Ferrell had on file with the West Virginia Secretary of State. Those addresses, however, either did not exist or corresponded to vacant buildings or invalid P.O. boxes. (Dkt. 330 4-9.) Because plaintiffs, in attempting to effect service, are entitled to rely on addresses provided by corporate defendants to the Secretaries of State in the states in which they do business, the Court deems service effected on Ferrell. See, e.g., Kroger Co. v. Door Control Servs., Inc., No. 12-cv-0956, 2012 WL 4891560, at *3 (W.D. La. Oct. 15, 2012) (service by mail at address provided by Secretary of State was "all that was required," even though the address was incorrect and the letter went "unclaimed" at the P.O. Box to which it was sent); Markel Ins. Co. v. Dahn Yoga & Health Ctrs., Inc., No. C09-1221RSM, 2010 WL 1980307, at *5 (W.D. Wash. May 17, 2010) ("Plaintiff was entitled to rely on [the defendant's] corporate statement on file with the Washington Secretary of State in determining whom to serve, and where to effect that service"). Accordingly, Plaintiff's motion is granted and default is entered against Ferrell under Rule 55(a) of the Federal Rules of Civil Procedure.
