ORDER: Plaintiff's application for leave to proceed in forma pauperis #3 is granted. The Court orders the trust fund officer at Plaintiff's place of incarceration to deduct $11.18 from Plaintiff's account for payment to the Clerk of Court as an initial partial payment of the filing fee, and to continue making monthly deductions in accordance with this order. The Court directs the Clerk of Court to send a copy of this order to the trust fund officer of the facility having custody of Plaintiff who is instructed to ensure that the Jail's records reflect all of the cases listed in this order and to make proper deductions. Although the complaint states a claim against the named Defendants except for Thomas Dart (who is dismissed without prejudice), summonses will not issue at this time. The Court grants Plaintiff's motion for attorney representation #4 . The Court recruits attorney Peter F. Lovato of Skarzynski Marick & Black LLP, 205 North Michigan Ave., Suite 2600, Chicago, Illinois, to represent Plaintiff in accordance with counsel's trial bar obligations under N.D. Ill. Local Rules 83.11(g) and 83.37. By June 12, 2019, after counsel has had an opportunity to confer with Plaintiff and conduct a preliminary investigation of his claims, counsel should inform the Court whether he intends to proceed with the current complaint or submit an amended complaint, if he is able to do so pursuant to Fed. R. Civ. P. 11. Recruited counsel falls within the class of users listed in the Electronic Public Access fee schedule adopted by the Judicial Conference of the United States, therefore, counsel shall be exempt from the payment of fees for access via PACER to the electronic case files maintained in this court for the above-captioned case and the previous cases filed in this court by this plaintiff (17 C 4799, 17 C 6725, 17 C 7400, and 18 C 7147) only. Counsel is directed to open a separate PACER account for use in this case only. Fees are exempt for this case and the previously identified cases filed in this court by this plaintiff only; counsel shall not be exempt from the payment of fees incurred in connection with other uses of the PACER system in this court. This exemption is valid immediately and for the duration of counsel's participation in this matter. This exemption may be revoked at the discretion of the Court at any time. Counsel shall contact the PACER Service Center at 1-800-676 6856 or via the link below to create a new PACER account and to make any necessary arrangements for the waiver. The Clerk is directed to send a copy of this order to Plaintiff, attorney Lovato, the Systems Department of the Northern District of Illinois, and the PACER Service Center at http://www.pacer.psc.uscourts.gov/register.html.
