ORDER: Plaintiff Nazir Jabali Bey has filed this lawsuit against U.S. Bank National Association ("U.S. Bank"); Andrew Cecere, the Chairman, President, and Chief Executive Officer of U.S. Bancorp; and the Board of Directors of U.S. Bancorp (collectively, "Defendants"). Plaintiff claims that Defendants violated 29 of the National Bank Act of 1864 ("NBA") and inflicted emotional distress upon him by impeding his ability to sell his property. Defendants have filed a motion to dismiss for failure to state a claim under Federal Rule of Civil Procedure 12(b)(6). For the following reasons, the Court grants Defendants' motion #10 .
